Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hover — the macOS application and related website at hov3r.app (collectively, the "Service"), operated by Hover ("we", "us", or "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Hover. By using the Service you represent that you meet this requirement and that all information you provide is accurate.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@hov3r.app if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription and Billing

Hover is offered on a subscription basis. A 7-day free trial is available for new accounts. After the trial ends your subscription will automatically renew at the applicable rate unless cancelled before the renewal date.

All fees are charged in US dollars. We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current billing period; you will retain access until then.

4. Refund Policy

We do not process refunds through Stripe. Any refund request submitted directly through Stripe will not be accepted.

If you believe you are entitled to a refund, you must contact us at support@hov3r.app and explain the issue. We review refund requests on a case-by-case basis. Approved refunds are issued at 90% of the amount charged — the remaining 10% accounts for Stripe payment processing fees that are non-recoverable regardless of refund. Refunds are not guaranteed and are issued solely at our discretion.

5. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to develop a competing product.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Use automated means (bots, scrapers) to access the Service.
  • Violate any applicable law or regulation while using the Service.
  • Misrepresent your identity or provide false information.

6. Software Licence

Subject to these Terms and payment of any applicable subscription fees, Hover grants you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the Hover macOS application (the "Software") solely for your own personal, non-commercial purposes on up to the number of devices permitted by your subscription plan.

The Software is licensed, not sold. All title, ownership, and intellectual property rights in and to the Software remain with Hover. You may not sublicense, rent, lease, lend, or otherwise transfer the Software or your licence rights to any third party.

The Software is distributed as an installer package (".pkg") via GitHub Releases at github.com/ayellowplum/atmosreleases. Redistribution of the installer or any portion of the Software without our express written permission is prohibited.

Your licence to use the Software terminates automatically if you cancel your subscription, your trial expires, or your account is suspended or terminated. Upon termination you must cease all use of the Software and delete all copies in your possession.

7. Intellectual Property

All content, design, code, trademarks, and other materials in the Service are owned by or licensed to Hover. Nothing in these Terms grants you any ownership rights beyond the limited software licence described in Section 6.

8. Third-Party Services

The Service integrates with third-party providers including payment processors and infrastructure services. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Hover shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Hover and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for any violation of these Terms. Upon termination your licence to use the application ends immediately. Provisions that by their nature should survive termination (including liability limitations and ownership clauses) will do so.

Voluntary account deletion. You may request deletion of your account at any time from your account settings page. Before a deletion request can be submitted, any active subscription or free trial must first be cancelled through the billing portal. Once confirmed with your password, your account is scheduled for permanent deletion after a 24-hour grace period. During this window you may cancel the request and retain your account. After the grace period expires, your account credentials, device activations, and associated billing records are permanently removed. Certain records — including anonymised audit logs — may be retained for fraud prevention and legal compliance as described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will attempt to notify you by email and/or by displaying a notice on the website at hov3r.app at least 14 days before the changes take effect.

Continued use constitutes acceptance. If you continue to access or use the Hover application or website after the effective date of any updated Terms, you are deemed to have accepted those changes — regardless of whether you have visited the website, seen the update notice, or actively confirmed acceptance. It is your responsibility to check this page periodically for changes.

Users who have not recently visited the website. Because the Hover macOS application operates independently of the website, some users may not encounter an in-app or on-site notice of policy updates. Your ongoing use of the application after the effective date shown at the top of this page constitutes your acceptance of the then-current Terms, whether or not you received a direct notification. We recommend reviewing this page whenever you install an application update or at least every 90 days.

If you do not agree to the updated Terms, you must stop using the Service and, if applicable, cancel your subscription before the effective date.

14. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law provisions. Any disputes shall be resolved exclusively in the courts located in Vancouver, British Columbia, Canada.
